The following is a brief overview of the procedural timeframes for the FAA's Part 16 administrative complaint process. This is NOT intended to be used in place of the official Rules of Practice for Federally-Assisted Airport Proceedings, 14 CFR Part 16.

Notes:

  1. Time periods may be increased by the 3 day "mail rule," §16.17(c).
  2. Under §16.101, which may include, without limitation, any of the actions described in §16.29(b).
  3. Under §16.103, following initiation of the investigation. The Notice sets forth the areas of agency concern and the reasons therefore; requests a response to the notice within 30 days of service, and informs the respondent that FAA will, in its discretion, invite good faith efforts to to resolve the matter.
  4. Under §16.105 and §16.31 after matters addressed in FAA notice are not resolved informally.
  5. 60 days after the due date of the reply, §16.33(d).
  6. 20 days after the Director's determination, §16.109(c)(1).
  7. 110 days after the Director's determination, §16.241(a).
  8. 30 days from the due date of the reply, §16.241(c).
